  1. Introduction

These Leasing Management Terms and Conditions (“Terms”) govern the relationship between Notable Unique SDN BHD (“we,” “us,” “our”) and property owners (“you,” “your”) who engage our services to manage the leasing of their properties. By using our leasing management services, you agree to be bound by these Terms.

  1. Scope of Services

We will provide the following leasing management services:

  • Marketing and advertising your property to prospective tenants.
  • Conducting tenant screenings, including credit checks, employment verification, and reference checks.
  • Drafting, negotiating, and executing lease agreements on your behalf.
  • Collecting rent and security deposits.
  • Managing tenant communications and addressing any issues or concerns.
  • Conducting periodic inspections of the property.
  • Coordinating repairs and maintenance as needed.
  • Handling lease renewals and tenant turnovers.
  1. Owner Responsibilities

As the property owner, you agree to:

  • Provide accurate and up-to-date information about your property.
  • Maintain the property in compliance with local laws and regulations.
  • Approve or reject potential tenants within a reasonable timeframe.
  • Provide necessary funds for repairs and maintenance in a timely manner.
  • Cooperate with us in addressing any issues that may arise with the property or tenants.
  • To promptly pay monthly maintenance fee and assessments charges.
  1. Fees and Payments

Our fees for leasing management services are as follows:

  • Leasing Fee: A one-time fee of 9% to 150% of the first month’s rent, payable upon successful placement of a tenant.
  • Management Fee: A recurring fee of 8% to 10% of the monthly rent, payable on the first of each month.
  • Additional Fees: Any additional services, such as handling evictions or major repairs, will be billed separately as agreed upon.

All payments will be deducted from the monthly rent collected, and any remaining balance will be transferred to your designated account.

  1. Term and Termination
  • Termination by Owner: You may terminate this agreement at any time by providing 90 days’ written notice. Any outstanding fees or expenses will be due upon termination.
  • Termination by Us: We reserve the right to terminate this agreement with 90 days’ written notice if you fail to comply with these Terms or if the property is deemed unmanageable.
  1. Liability and Indemnification

We will perform our services with reasonable care and skill. However, we are not liable for:

  • Any damage to the property caused by tenants or third parties.
  • Loss of rent due to tenant default or vacancy.
  • Any legal action taken against the property or the owner.
  • You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your failure to comply with these Terms or any legal requirements.
  1. Confidentiality

We will treat all information related to your property and tenants as confidential and will not disclose it to any third party without your consent, except as required by law.

  1. Amendments

We reserve the right to amend these Terms at any time. Any changes will be posted on our website, and continued use of our services after the changes are posted will constitute your acceptance of the modified Terms.
